Introduction

Welcome to the Driving Accessibility platform. If you continue to browse our website or wish to make use of our services you are agreeing to comply with and be bound by the following terms and conditions of use (“Terms”) which govern our relationship with you.

 

The term “we” or “Recite Me” means Recite Me Ltd, a company incorporated in England with company number 07258145 and whose registered office address is at Baltimore House, Baltic Business Quarter, Gateshead, Tyne and Wear, United Kingdom, NE8 3DF (“us” and “our” will be construed accordingly). Recite Me Ltd is the owner and operator of the Driving Accessibility website located at https://www.drivingaccessibility.com/ (the “Website”) and the services, software, applications and tools which are accessible through the Website (collectively referred to in these Terms as the "Platform").

 

The term “you” or the “user” refers to any user of our Platform.

 

If you disagree with any part of these Terms, please do not use our Platform.

 

Provision of Services

In order to purchase any Services from us, you warrant that you are operating as a business entity, and not as a consumer. You further warrant to us that you are authorised by the organisation which has subscribed to the Platform to register for our Services.

 

Unless otherwise stated, Recite Me owns the intellectual property rights in the Platform and all content and material on the Platform. Subject to the license below, all these intellectual property rights are reserved.

Recite Me offers a suite of accessibility solutions designed to enhance user experiences, identify and address accessibility issues, showcase your commitment and efforts to accessibility and compliance, and gather feedback for ongoing improvement (the “Services”).

 

The functionality and features of the Services are described on the Website.

 

Recite Me grants users a revocable, non-exclusive, non-sublicensable license to use the Services, in accordance with the provisions set out in these Terms. All other rights, title and interest in and to, the Services are expressly reserved by Recite Me. You are not permitted to re-sell or re-license the Services or any content you may find on the Platform to any third party.

 

You are responsible for the security of the equipment, network and environment in which you make use of the Services. You should only use the Services through a secure network.

 

Subscribing to use our Services

We charge subscription fees for use of the Services. If any subscription fees are due for payment and such fees are not paid (whether by you or by any other entity or educational institution which may have granted you user rights), this may result in your account being suspended or deactivated.

 

Recite Me also reserves the right to suspend or terminate your user account and your access to the Services if you breach any of these Terms.

 

We offer standard support services to enable you to make proper use of our Services. Enhanced support requests may result in further charges being quoted to you, should you wish to receive such additional support.

 

Similarly, should you request any changes to the standard features or functionality of the software, we may quote you additional fees for carrying out such work.

 

Copyright and licence

This Platform contains software, code and materials which is owned by or licensed by Recite Me. This material includes, but is not limited to, the software through which the Services are provided, together with the content, design, layout, look, appearance and graphics shown on the Platform. You are not permitted to copy any aspect of our Platform, other than the content which you are permitted to download and use for your own personal use to assist you in making use of our Services.

 

You are granted a licence to use the material contained in this Platform subject to the restrictions described in these Terms.

 

Unless otherwise specified in these Terms, no user of the Platform is permitted to:

 

  • republish for commercial purposes any material from this Platform (including republication on another website);

  • sell, rent, license, sublicense, lease, distribute, copy, duplicate, publish or reproduce material from the Platform and any material or any part thereof for use by any third party;

If you breach these Terms in any way then the licence granted to you will be automatically terminated upon such breach and we may take such action as we deem appropriate to deal with the breach, including terminating your membership, suspending or prohibiting your access to the Platform and/or bringing court proceedings against you.

 

You must retain, and must not delete or remove any copyright notices and other proprietary notices placed by us on any material.

 

User Content

Your use of the Platform may involve you to submit text, images, videos or other content by you ("User Content").

 

You shall be solely responsible for your own User Content and the consequences of using such content on our Platform.

 

You represent and warrant that:

 

  1. you own or have the necessary rights and permissions to use and authorize us to use all copyright, trademark or other proprietary rights in and to any User Content to use of such content on the Platform and in accordance with these Terms; and

 

  1. whilst you retain all of your ownership rights in your User Content, by submitting your User Content, you hereby grant us, in addition to any other rights which we may have, a worldwide, non-exclusive and transferable license to make use of your User Content for the purposes of providing our Services to you.

 

Any breach of the above warranties will result in the user’s account being immediately terminated and may result in the user becoming liable to legal action.

 

No warranties

This Platform is provided “as is” without any representations or warranties, express or implied. We make no representations or warranties in relation to this Platform or the information and material provided on this Platform. 

 

We do not warrant or guarantee the confidentiality of any communications made through the Platform, that the Platform is compatible with your computer system or that the Platform, or any software or services provided to you will be free of viruses, worms, trojan horses or disabling devices or other destructive or contaminating code.

 

You accept all of these risks and are responsible for implementing safeguards to protect the security and integrity of your computer system. You are responsible any costs incurred by you as a result of your use of the Platform.

Nothing in these Terms will limit or exclude our liability for death or personal injury resulting from negligence, limit or exclude our liability for fraud or fraudulent misrepresentation or limit any of our liabilities in any way that is not permitted under applicable law. Our maximum financial liability shall in no circumstance exceed the subscription fee paid by the user for use of the Platform.

 

By using this Platform, you agree that the exclusions and limitations of liability set out in these Terms are reasonable. If you do not think they are reasonable, you must not use this Platform.

 

Indemnity

If you breach these Terms you will be held fully responsible for any loss suffered by us as result of such breach and will be held accountable for all losses caused or profits gained by you from breaching these Terms.

 

You agree to indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses (including, without limitation, legal expenses) incurred or suffered by us arising out of any breach by you of any provision of these Terms.

Waiver

Jurisdiction and governing law
